II. Right of Withdrawal

If you order as a consumer, you may have a right of withdrawal according to one of the following instructions. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.

Right of Withdrawal

You have the right to withdraw from this contract within thirty days without giving any reason. The withdrawal period is thirty days from the day you or a third party named by you, who is not the carrier, have taken possession of the last goods.

To exercise your right of withdrawal, you must inform us (Animus Medicus GmbH, Johanna-Dachs-Str. 34, 93055 Regensburg) by means of a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You can use the attached model withdrawal form, but it is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods. The cost is estimated to be a maximum of about 10 €. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Special Notes

The right of withdrawal does not exist for contracts for the supply of goods that are made to the consumer's specifications or are clearly personalized or which, due to their nature, are not suitable for return.

III. Conclusion of Contract

The products and services displayed in the online shop do not represent binding offers; rather, they are an invitation to the customer to submit a binding offer to the company. By clicking the button "ADD TO CART" assigned to the item, the customer can select individual items for purchase. After clicking the "CART" link, the customer can check and change the contents of the cart, i.e., the items selected for the order, for input errors and make further details about the order by clicking "PROCEED TO CHECKOUT."

Before submitting the order, all details can be viewed again in an order summary and changed by clicking "EDIT." By clicking the "PLACE ORDER" button, the customer makes a binding offer.

The company immediately sends a confirmation of receipt of the order by automated email after the order is submitted. This is not an acceptance of the order. The company is entitled to accept the customer's contract offer within five working days by sending an order confirmation to the customer. Otherwise, the customer is no longer bound by their order.

IV. Retrieval and Storage of the Contract Text

The customer can save or print the data of their order (contract text) after submitting their declaration in the online shop. To do this, the customer clicks on "Print Order Confirmation now!" at the end of the order. Additionally, the order can be tracked in the login area of the registered customer under "Orders." We do not store the contract text additionally.

V. Warranty

For the goods you have purchased, you are entitled to statutory warranty rights under the legal conditions.

The contract languages are German and English.

VII. Reservation of Delivery

We reserve the right to deliver a different item than the one purchased if this is reasonable for the customer. This applies, for example, to technical changes or changes in weight that do not affect the functionality of the purchased item, as well as minor changes in shape and color in items where design does not matter.

The conclusion of the contract is also subject to the reservation that we do not receive proper or timely delivery from our suppliers. This does not apply if we are responsible for the lack of delivery. In the case of unavailability or only partial availability of the service, we will inform the customer immediately; in the case of withdrawal, the consideration will be refunded immediately to the customer.
